 Be it enacted by the Quorum Court of the County of White, State of Arkansas: AN ORDINANCE TO BE ENTITLED: AN EMERGENCY ORDINANCE AMENDING THE PERSONNEL POLICY OF THE GOVERNMENT OF WHITE COUNTY, ARKANSAS.

 

Section 1. The Quorum Court hereby adopts the following amendments to the Personnel Policy of the Government of White County, Arkansas.

 

Section 2. Paragraph 4 of Chapter 4, Section A, is hereby repealed. The text of the amended paragraph is now as follows:

4. Elected officials and/or department heads may grant compensatory time off at 1 1/2 times the normal rate for overtime worked in excess of the normal working hours of the office or department. No compensatory time shall be accrued without approval of the elected official/department head and shall not exceed 40 hours per person and must be used within one year.

Section 3. The following amendments are hereby added to the existing Personnel Policy of the Government of White County, Arkansas.

4. It is White County’s Personnel policy to compensate for any overtime worked by giving compensatory time-off with pay at 1 1/2 times the normal rate. Under certain circumstances, however, overtime pay is required by law in-lieu-of-compensatory time-off.

5. No compensatory time-off or overtime pay shall be accrued without the approval of the elected official or department head.

6. The day-to-day administrative responsibilities of each county official shall continue to rest within the discretion of that office’s respective elected responsibility by requesting, in advance and with all other funding requests for the fiscal year, any expected overtime pay in his or her office. Any accrued overtime pay shall first be paid from this amount. In the event that the need for overtime pay exceeds the amount of funds budgeted for such overtime, it is the responsibility of the elected official for that department to request from the Quorum Court more funding. This request shall occur at the first Quorum Court meeting following the occurrence of the shortage.

7. Failure to notify the Quorum Court of unbudgeted, accrued overtime and to request additional funds, as required in paragraph 6, shall be a violation of this ordinance; a fine of $500.00 shall be given to the elected official who violates this ordinance,

 

Section 4. Thereby, the Quorum Court adopts this document as an amendment to the Personnel Policy of the Government of White County, Arkansas.

Section 5. It shall be the responsibility of the County Clerk to publish and provide copies of this document to each elected official and each county employee.

 

Section 6. It is hereby determined that there is an immediate need for a personnel policy to protect the public’s health, safety and welfare, therefore an emergency is declared to exist and this ordinance shall be in full force and effect from and after its passage.
